(a) Enhancing international law enforcement cooperation, including extradition measures

Extradition, for example, was governed by a law enacted in 1977.

Law no. 302 2004 on international judicial cooperation in criminal field replaced Law no. 296 2001 on extradition.

Extradition furthers international cooperation in criminal justice matters and strengthens domestic law enforcement.

UNODC has also developed a draft model law on extradition to assist Member States in adapting their extradition legislation to support relevant treaties or as a legal basis for extradition in the absence of a treaty.

Under Canadian law, extradition is a two step process. The first involves a hearing at which a judge considers whether a factual and legal basis for extradition exists. The person sought for extradition may submit evidence at the judicial hearing.

The objective here is a criminal law instrument that would facilitate judicial cooperation, mutual assistance and extradition.

Article 44 (Extradition) of the same Convention provides that a State Party whose law so permits may grant the extradition of a person for any of the offences covered by this Convention that are not punishable under its own domestic law .

1.11 In relation to Law No. 53 of 1955 on the extradition of criminals, which enables Syria to cooperate on extradition matters with other States, the Committee is interested in knowing whether the application of this law is subject to the pre existence of a treaty on extradition with the requesting State or not.

All national policies involving asylum, extradition, removal and forcible transfers must conform to international, regional and national law.

As extradition is a major procedure in counter terrorism agreements and measures, all States should endeavour to elaborate extradition rules that are compatible with international law and the rules of other States.

For persons being prosecuted, the law allowed extradition for all offences constituting crimes under the laws of the requesting State.

(e) Extradition and rendition of terrorism suspects are other areas in which the rule of law must be fully respected.

In the area of extradition, Egypt cooperates with other States, both in terms of extradition and also in the exchange of prisoners, in consonance with the norms of international law, with the reservation concerning extradition of foreign prisoners in drug related cases, namely that extradition should take place after service in Egypt by such prisoners of the full sentence passed by Egyptian courts.
