(d) Grounds of appeal before the United Nations Appeals Tribunal

1. The statute of the United Nations Administrative Tribunal provides, in article 11, for an appeal procedure from a judgement rendered by the Tribunal.

The Tribunal Especial Primero de Apelación confirmed the sentence on 14 March 1980 without an appeal hearing.

The Court also added that an application under article 16 (3) MAL is not an appeal against the decision of the tribunal.

For this purpose rules governing the detention of persons awaiting trial or appeal before the Tribunal or otherwise detained on the authority of the Tribunal ( quot the rules of detention quot ) were adopted by the Tribunal at the end of its third session on 5 May 1994.

2.9 President Biya's intention to appeal the judgement, after having ordered the author's rearrest, was frustrated because the law establishing the Military Tribunal did not provide for the possibility of appeal in cases involving high treason.

In the main, these staff have been offered contracts of employment, as United Nations employees with the Tribunal, for a 12 month period.

To make it possible for the accused or the Prosecutor to appeal, without rendering the structure of the Tribunal too cumbersome, the Tribunal has been divided into two trial chambers, each with three judges, and an appeals chamber consisting of five judges.

Scheduling well in advance and better coordination between the two Tribunals will be required to avoid placing too heavy a burden on the Appeal Chambers of the Tribunal.

11. With regard to appeals procedures, provision might be made for an appeal to the chamber of the tribunal which did not hear the case in first instance.

The Chambers of the Tribunal are composed of 16 permanent judges, including two judges of the International Tribunal for Rwanda serving in the Tribunal's Appeal Chamber (Judges Mehmet Güney (Turkey) and Inés Mónica Weinberg de Roca (Argentina)) and up to nine ad litem judges.

The emergency appeal programmes focused on food aid, emergency employment creation, repair and reconstruction of the conflict damaged infrastructure in kind and cash assistance, and mobile health clinics.
