As at 2 September 2005, there were 91 women in immigration detention.

On 2 May 2000, the complainant was detained in immigration detention for purposes of removal.

103. On 17 January 1994 there was an uprising by some 300 inmates of the Sensuntepeque detention centre in a protest against physical ill treatment at the hands of the guards, the poor state of essential services at the detention centre, and overcrowding.

Sixteen indictees are awaiting trial in our detention centre their cases will commence as soon as trial capacity allows.

102. On 18 November 1993 inmates at the San Francisco Gotera detention centre, used to house more dangerous prisoners, instigated a violent riot that led to the selective murder of 27 of the 130 prisoners housed in the first of the detention centre compounds.

With regard to detention of illegal immigrants and asylum seekers, the Working Group urges Governments to ensure that the right to challenge the lawfulness of detention is, in practice, guaranteed to any foreign national detained under their immigration law.

The Prison and Detention Centre Law, which was passed on 31 May 2005, stipulated that men and women in detention should be in separate facilities with special attention to women with children.

On 17 June 2005, the Prime Minister announced a number of changes to both the law and the handling of matters relating to people in immigration detention.

Such altercations between authorities competent in immigration matters repeatedly occurred decisions favourable to Mr. Ali were later set aside by other authorities but he remained in detention.

The Working Group conveys its appreciation to the Government for having submitted information reporting that the above mentioned three persons are no longer held in immigration detention.

Finally, the Working Group invites States to guarantee the effectiveness of the right to challenge the lawfulness of detention by any foreign national detained under immigration laws.
