The Firearms Act

The importation, exportation and licensing of firearms and ammunition are controlled under the provisions of the Firearms Act 1998 32, the Firearms Amendment Act 2002 12, the Customs Act Cap.

The Firearms and Ammunition Act 1990 regulates the importation, possession and handling of firearms.

The Firearms Act prohibits the illicit acquisition of arms and ammunition.

Legislation currently under consideration for amendment includes the Firearms Act, the Gunpowder and Explosives Act and the Money Laundering Act.

The UN Firearms Protocol will be implemented in the Weapons and Ammunition Act.

The Firearms Act does not provide for the sharing of information with foreign counterparts to enable cooperation in preventing illegal shipments of firearms.

The Congolese Act of 21 February 1950 regulating firearms and ammunition makes it punishable to import, transport, possess, sell or discard firearms and ammunition.

The implementation does not require amendments to the Firearms Act but the provisions on firearms offences in the Penal Code need to be supplemented.

Sections 40 to 49 of the Act set out the conditions governing exports, imports or transit of firearms and ammunition by persons possessing firearms transportation notes, European firearms passes and by business entities.

One of the objectives of the Bill is to repeal the Firearms Act of 1940.

Firearms and Ammunition Act 1990 regulates the importation, possession and handling of arms and ammunition.

Section 33 (2) of the Firearms Act 1998 32 and the Firearms Amendment Act 2002 12 permits the transit of firearms and ammunition provided the arms and ammunition are bona fide cargo and entered on the manifest of the vessel or aircraft and declared to the Customs Department.

The Firearms and Ammunitions Act of 1 November 1973, updated by Act 31 of 1980 contains the dispositions of the above Protocol.

The new Firearms Bill takes on board various provisions (which were absent from the Firearms Act of 1940) contained in regional and international Conventions Protocols to which Mauritius is party.

Under section 6 (1) of Firearms Act, a person who wishes to export firearms from Barbados is required to apply to the Commissioner of Police for a firearm export licence.

In Mexico the federal legislation governing the manufacture, import, export, marketing, marking, registration, licensing and control of firearms and explosives is the Federal Act on Firearms and Explosives (LFAFE), along with its regulation.

Although the disclosure of the names and locations of brokers involved in an arms transaction is not required, no firearm or ammunition may be sold or transferred other than by a registered dealer in firearms under the current Firearms Act.

The Customs Act provides the overarching legislative framework within which the Customs Department operates to prevent the illegal trafficking in firearms, ammunition and explosives.

Consequently, the penal provisions on arms offences that allow a sentence of imprisonment, which are currently included in the Firearms Act (1 1998) and Public Order Act (612 2003), would be placed in the Penal Code.
