As almost all claims filed on behalf of the deceased detainees include losses exceeding USD 100,000, Kuwait filed the claims with the Commission as category D claims.

Four of these claims were filed as category D claims in the regular claims programme, while the fifth claimant filed a category C claim in this late claims programme.

As stated in paragraph 15 of the first late claims report, before commencing its review of all of the claims included in this late claims programme, the Panel undertook an electronic matching of all the late filed claims as against all of the other claims filed with the Commission.

Duplicate claims are two or more claims filed by an individual in the same claims category.

As noted above, all 603 claims were filed by Kuwait pursuant to decision 12.

However, two of these claimants filed duplicative claims in the bedoun programme, reducing the number of claims filed by such claimants to 957.

However, 14 of these claimants filed duplicative claims in the bedoun programme, reducing the number of claims filed by such claimants to 29,051.

However, 11 of these claimants filed duplicative claims in the bedoun programme, reducing the number of claims filed by such claimants to 387.

However, 10 of these claimants filed duplicative claims in the bedoun programme, reducing the number of claims filed by such claimants to 1,436.

A total of 3,450 category A claims and 672 category C claims were filed by the four Governments as part of this late claims programme.

As stated in paragraph 25, a total of 959 claims were filed by such claimants.

As stated in paragraph 21, a total of 29,065 claims were filed by such claimants.

As stated in paragraph 22, a total of 398 claims were filed by such claimants.

The total number of claims recommended for payment includes 31,715 claims filed as part of the bedoun programme and 10 claims filed pursuant to decision 12, comprising one claim for losses resulting from landmine explosions and nine claims for the losses of additional deceased detainees.

As a result, over 4,000 Palestinian late claims were identified to have matching claims that were filed during the regular filing period.

The first step was the electronic matching of claims and the manual verification of matches in order to identify those claims filed under the late claims programme by claimants who previously filed claims during the regular filing period.

This compares with an incidence of 48 per cent in the regular category D claims programme as a whole 69 per cent in the regular category D claims filed by Jordan and 44 per cent in the regular category D claims filed by Kuwait.

The secretariat identified 25 category A claims filed by the Government of the Sudan for a high amount by claimants that had also filed claims in other claim categories.

As noted in paragraph 3 above, the Panel deferred five category C claims that were identified as potentially competing with other claims for business losses filed with the Commission.

A preliminary examination of these claims revealed that some, but not all, of the Kuwaiti companies in issue had filed claims with the Commission, which were being processed as E4 claims.

Decision concerning the late filed category A and category C claims programme

There are instances where claimants filed duplicate claims in the fourth instalment.

As a result of further information received from the Government of India, three claims submitted by the Government of India have been identified as having been filed for a higher amount in category A by claimants who had also filed claims in another claim category.

The Panel recommends no compensation in respect of three category C claims that are duplicates of three other claims filed within this late claims programme.

A preliminary examination of these claims also revealed that in some instances the Kuwaiti companies in question had filed separate claims with the Commission, which were being processed as E4 claims. However, there were a number of instances where the Kuwaiti company had not filed a separate claim with the Commission.

(d) have not had their claims filed with the UNCC by any Government or international organization in any claims category during the regular claims programme and

The Palestinian Authority filed a total of 2,374 category D claims under the programme.

The Panel considered the situation of claims filed by spouses in its First Report.

A total of 37 confirmed matches were identified, which related either to claims filed by the same claimant within the bedoun programme or to claims filed by the same claimant in different claim categories.

As the category D Palestinian late claims were not filed until the end of the regular category D work programme, matches between regular and Palestinian category D claims were identified upon review of the latter claims.

The final group of claims contains 957 claims filed by claimants who are in neither the PACI nor the Executive Committee database.

In order to evaluate the extent to which the individual claimants might have asserted losses in connection with a Kuwaiti company that had filed a claim in category E , the D and E4 Panels requested that computer searches be conducted against the Commission's claims database from claims filed in category D and against claims for business losses filed by individuals for amounts less than USD 100,000 (category C claims).

(d) 458 claims filed by claimants identified as provisionally ineligible or of uncertain eligibility according to their data in the Executive Committee database

Well over half (92) of the 160 known claims were filed within the past three years.

As a result of manual searches for matching and related claims, a number of claims were identified in the fourth instalment that were submitted by wives whose husbands had filed claims, predominantly in category A , during the regular filing period.

These 12 detainees are not included on the ICRC list and therefore, Kuwait has not filed claims in respect of these detainees as part of the original 605 claims comprising the special instalment.
